TERMS OF SALE

These Terms of Sale govern your purchases of services on Momio. We only accept purchases where the buyer accepts our Terms of Sale.

1. Prices
All prices on Momio include V.A.T. and are subject to change without notice.

2. Purchasable goods
Momio sells a variety of virtual goods and currencies. They are:

2.1. Diamonds and sapphires
Diamonds and sapphires are virtual currencies on Momio. They can be won or earned but also bought with real money by using one of the payment options presented on Momio. You must be logged in on Momio to use your diamonds and sapphires. Diamonds or sapphires cannot be transferred to other accounts under any circumstances.

 

2.2. Momio Plus membership
Momio Plus membership gives access to certain privileges, as stated in the Momio Plus section on Momio, for the duration of the membership. The duration of the membership is in calendar days. Momio Plus membership can be purchased as a one-off purchase or as a subscription. Momio Plus membership cannot be transferred to other accounts under any circumstances.

 

2.3. Ad free Momio
Ad free is a service that can be purchased with a one time payment and will last for the lifetime of the account it is bought for. Ad free removes all ads from external parties in any form for the account – the account will however still see communication from Momio ApS around Momio products. Ad free Momio cannot be transferred to other accounts under any circumstances. Ad free does not include any virtual currencies or other Momio Plus privileges.

 

3. Purchases
Purchases are done with “real world” money and grant a limited, personal, non-transferable, non-sublicensable, revocable license to use virtual goods and virtual currencies on Momio, explained in more detail under point 2.

Momio ApS may manage, regulate, control, modify or eliminate virtual items and/or merchandise at any time, with or without notice. Momio ApS shall have no liability to you or any third party in the event that Momio ApS exercises any such rights.

 

4. Subscriptions
Momio Plus can be bought as a subscription via Apple’s App Store and Google Play. The subscriptions are administered via App Store and Google Play’s own subscription interfaces. Subscriptions cannot be transferred to other accounts under any circumstances.

 

5. Payment security
Momio ApS uses third party payment providers and therefore do not store any credit card, phone number or bank account information. Our payment providers fully live up to European industry security standards. All credit card, phone number and bank account information is stored by the payment provider solely in encrypted form in high security computer centres. All collection and storage of sensitive information by the payment provider is in line with current EU legislation.

 

6. Personal data
When you are making a purchase, we may ask for an email address for sending a receipt. Processing of your email address is necessary for the performance of the contract to which you is party.

 

7. Refunds
All purchases and redemptions made through Momio are final and non-refundable. The provision of virtual currency, membership and other services for use in Momio is a service provided by Momio ApS that commences immediately upon acceptance by Momio ApS of your purchase.

 

8. Liability
Any virtual goods or services bought for your account are protected by your Momio password. It is your sole responsibility to guard your password so that others can’t access your account. You are solely liable for any loss of virtual goods or bought services resulting from the abuse of your account and password. If you experience or suspect any such abuse you must immediately report it to Momio.

 

9. Losing access to Momio
There are some instances where you may lose access to your Momio account and everything it contains, including but not limited to virtual items, currencies and membership. In those instances, you will not be able to get them transferred to another account either. Those instances include for example:


a. You break the rules in a manner that in Momio ApS’s judgement must result in your account being deleted.
b. You delete your own Momio account.
c. You make payments while being younger than 18 years old without permission from your guardian, regardless of payment method.
d. In some aggravated cases of breach of our rules we retain the right to delete all accounts created on a device like for instance a specific iPad, in which case all accounts made on the device will lose access to Momio and any virtual goods or Momio Plus membership days purchased.

10. Legal matters
You agree that all disputes between you and Momio ApS shall be governed by the laws of Denmark, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Momio ApS must be resolved exclusively by a court located in Copenhagen, Denmark.

You irrevocably waive all rights to bring or participate in any class action suits or claims regarding the matters related hereto.

If any part of these Terms of Sale is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms of Sale constitute the entire agreement among the parties relating to this subject matter.

 

In the event that a purchase order, confirmation letter, or other communication is inconsistent with these Terms of Sale, these Terms of Sale will govern, unless expressly agreed in writing otherwise by an executive officer of Momio ApS.
